Terms of Service

These Terms of Service ("Terms") govern your access to and use of Turbostream (the "Platform" or "Service"), a real-time streaming analysis platform with AI-powered insights, operated by Turboline LTD ("Turboline", "we", "us", or "our").

By accessing or using the Platform, whether through our hosted SaaS offering, an Azure Marketplace deployment, or related services, you agree to be bound by these Terms.

1. Scope of These Terms

These Terms apply to your use of:

  • The hosted Software-as-a-Service (SaaS) version of Turbostream
  • The Azure Marketplace containerized deployment of Turbostream
  • All related services, including:
    • Real-time WebSocket and streaming feeds
    • AI-powered analysis and insights
    • Scriptable filtering and processing
    • Data feed and integration marketplace
    • APIs, dashboards, and associated tooling

These Terms do not apply to the open-source version of the software distributed via GitHub, which is governed exclusively by the Mozilla Public License 2.0 (MPL 2.0).

2. Eligibility and Account Registration

To use the Platform, you must:

  • Be at least 18 years old
  • Have the legal authority to enter into these Terms
  • Provide accurate and complete registration information

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your use of the Platform complies with applicable laws and regulations

3. Azure Marketplace Users

If you access or deploy Turbostream via Microsoft Azure Marketplace:

  • Your use is also subject to Microsoft's Azure Marketplace terms
  • Billing, provisioning, and infrastructure deployment may be handled by Microsoft
  • These Terms govern your use of the software and services, not Microsoft's cloud infrastructure

In the event of a conflict, Azure Marketplace terms govern billing and deployment, while these Terms govern platform usage and functionality.

4. License to Use the Platform

Subject to these Terms, Turboline grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for lawful business or personal purposes.

You may not:

  • Reverse engineer, decompile, or disassemble proprietary components
  • Circumvent usage limits or security safeguards
  • Resell, sublicense, or commercially exploit the Platform without written permission
  • Use the Platform to develop or operate a competing service

5. AI-Powered Features and Outputs

The Platform may provide AI-generated insights, summaries, alerts, or recommendations.

You acknowledge and agree that:

  • AI outputs are probabilistic and informational
  • Outputs may be incomplete, inaccurate, or misleading
  • You are solely responsible for verifying and acting on outputs
  • AI outputs do not constitute financial, legal, medical, or professional advice

Anonymized Training Use.
To improve the Platform, Turboline may use anonymized and aggregated configuration data, filtering scripts, and script-generation outputs for internal research, testing, and model fine-tuning. Such data is processed in a manner designed to prevent identification of individual users or their underlying data.

6. Data Streams, Feeds, and Marketplace Content

The Platform may provide access to:

  • Third-party or community-provided data feeds
  • User-generated or external streaming data
  • Marketplace-listed integrations, scripts, or connectors

Turboline does not:

  • Own third-party data feeds
  • Guarantee their accuracy, availability, or continuity
  • Assume liability for third-party content or services

You are responsible for ensuring you have all necessary rights to access, process, and analyse any data you connect to the Platform.

7. Scriptable Filtering and Custom Logic

Turbostream allows users to create and run scripts, filters, or logic within the Platform.

You agree not to:

  • Introduce malicious or harmful code
  • Attempt unauthorised access or privilege escalation
  • Interfere with system integrity, availability, or other users

We reserve the right to restrict or disable scripts that pose security, legal, or operational risks.

8. Open-Source Software

Certain components of the Platform may incorporate open-source software.

  • Open-source components are governed by their respective licences
  • The standalone open-source version on GitHub is governed by Mozilla Public License 2.0 (MPL 2.0)
  • Hosted services, managed infrastructure, AI systems, and marketplaces are not open source and are governed by these Terms

9. Fees, Plans, and Billing

Some features or usage levels may require payment.

  • Pricing and plans are disclosed at the time of purchase
  • Fees are non-refundable except where required by law
  • We may modify pricing or plans with reasonable notice

For Azure Marketplace users, billing is handled by Microsoft in accordance with their terms.

10. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable laws or regulations
  • Infringe intellectual property or privacy rights
  • Conduct unlawful surveillance or monitoring
  • Abuse system resources or disrupt services
  • Distribute malicious, deceptive, or harmful content

Violation of this section may result in suspension or termination.

11. Termination

We may suspend or terminate your access to the Platform:

  • For violation of these Terms
  • For security, legal, or operational reasons
  • For prolonged inactivity, where applicable

Upon termination, your right to use the Platform ceases immediately.

12. Intellectual Property

All proprietary rights in the Platform, including software, AI models, branding, and documentation, are owned by Turboline LTD or its licensors.

You retain ownership of your data, subject to the rights necessary for us to operate and provide the Platform.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE".

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURBOLINE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • TURBOLINE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • TURBOLINE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

15. Indemnification

You agree to indemnify and hold harmless Turboline LTD from any claims, damages, or liabilities arising from:

  • Your use of the Platform
  • Your data, scripts, or integrations
  • Your violation of these Terms or applicable law

16. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
